1. Data Privacy & Ownership

• Internal Use Only: We do not sell, rent, or lease user information. All customer data is used exclusively for internal operations to provide and optimize the service.
• Anonymization: Any data collected via tracking scripts for the purpose of platform analytics is fully anonymized.
• Cookies: We utilize cookies for essential service functions, including user authentication and session tracking.
• Data Deletion: Users have the right to delete any and all data related to their AI agents at any time.

2. AI Assistants & Retention Policy

• Retention: Data entered into or generated by AI Assistants/Agents is retained for a maximum of one year.
• User Purge: You may trigger the deletion of this data at any time by deleting the specific agent or assistant within your dashboard.

3. Subscription, Billing, and Refunds

• Cancellation: You may cancel your subscription at any time via your account settings.
• No Refunds: All payments are non-refundable. We do not provide prorated refunds or credits for partial months.
• Overage Charges: Usage limits (such as token counts) are dictated by your specific plan. If you exceed your plan's allocated limits, you agree to pay overage charges at the then-current rate.

4. Fair Use and Rate Limiting

To ensure platform stability and performance for all users, BadgerFy.ai enforces a Fair Use policy:

• Rate Limiting: We reserve the right to rate-limit services at our sole discretion in cases of excessive usage or suspected automated abuse.
• Service Integrity: Usage that negatively impacts the system's infrastructure may result in temporary suspension of service.

5. Service Availability & Maintenance

• No SLA: While we aim for consistent uptime, BadgerFy.ai does not provide a formal Service Level Agreement (SLA) or guaranteed uptime percentage.
• Maintenance Windows: Periodic maintenance is required. We strive to keep maintenance windows brief and, where possible, schedule them outside of standard US business hours (EST) to minimize disruption.

6. Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

7. Limitation of Liability

BadgerFy.ai is provided on an "as-is" and "as-available" basis. In no event shall BadgerFy.ai be liable for any damages arising out of the use or inability to use the services.
